Types of visas: immigration; non-immigration.
Types of non-immigration visas:
Visas of F1, M1 type – academic and non-academic study. These types of visas entitle a person to academic (F1) and non-academic (M1) (optional) study. You do not need a student visa if your training period is less than 18 hours a week and is the main purpose of the travel.
Visas of B1, B2 type – business and rest. This type of visa is granted to persons whose main purpose of travel is business (B1), rest or treatment (B2). Important! Under the presumption of the US Immigration and Nationality Act, every applicant who applies for a tourist visa is a potential immigrant apriori. To refute this claim, a person must prove that:
• his purpose of travel is business/or rest/or treatment;
• he plans to stay in the United States for a limited time;
• has sufficient funds to cover the travel;
• has an attachment to Ukraine (residence, economic and social ties, etc.).
Visas of I type – journalists. This category includes persons who are essential to the functioning of the foreign media, for example camera crews, reporters, video editing filmmakers. Persons who are not directly involved in this kind of activity (correctors, etc.) fall under a different category of visas. Husband/wife, children, accompanying the visa holder of I category can also fall into I category.
Visas of R type – religious workers. This type of visa is granted for religious ministers and full-time religious workers. This is a specific type of visa, which does not refer to many visitors. Since November 2008 the future employer must submit a petition (Form I-129) for each religious worker.
Visa of O1, O2, P1, P2, P3 type – athletes, artists, entertainment staff O1 visas are granted to persons who have outstanding abilities in the arts, science, business, sports, cinema, television and travel to the United States in order to work in an area where they found outstanding abilities. O2 visas are granted to persons accompanying O1 visa holder in order to assist them during sports or cultural events. P1 visa is granted to activists, traveling to the United States to participate in a particular sport international competition. P2 visa is granted to activists, traveling to the United States on an exchange program between the organization of the United States and other countries. P3 visa is granted to artists, traveling to the United States for presentation/training/study on the cultural program, exclusive of its kind.
P4 visa is granted to wife/husband/children of P1, P2, P3 visa holders.
Visas of H, L, E2, TN/TD type – work. Visas of this category are granted to persons whose main aim is temporary employment, and having a job offer in the United States.
Visas of A2 type – for investors. It is granted to persons engaged in investment activities in the United States in accordance with the laws of the United States.
Visas of N1 type – transit. This type of visas is granted to persons who cross the border the United States in transit. Transit visa holders are entitled to stay in the United States less than 29 days.
Visas of J1, J2 type – exchange visitors .This type of visa is granted to persons who participate in exchange programs under the US Act “On Mutual Educational and Cultural Exchange”.
